What does the Land Law say about inheritance and succession of rural property?
The Land Law in Angola establishes important rules for the inheritance and succession of rural properties. Here are the main points:
Indivisibility of Rural Property :
Article 65 of the Land Statute (Federal Law No. 4,504/64) is clear in stating that a rural property cannot be divided into areas smaller than the rural property module 1 .
Therefore, when heirs acquire ownership of rural properties through succession, they cannot divide them into areas smaller than the rural module.
Deadline for Decision :
The heirs have two years to decide on the division of rural land. If there is no agreement, an inheritance manager may be appointed, allowing the sale of the land with a majority agreement, without unanimity 2 .
Remember that improper division of rural properties can create legal uncertainty. If you need more information, we are at your disposal!
